1. PRESENTATION AND ACCEPTANCE
These Terms of Use govern your entire relationship with Tricot, an automated translation solution designed specifically for WordPress websites. Our service is operated by 9544-9872 Québec inc, doing business as Tricot, whose head office is located at 280 rue Beauchemin, Dolbeau-Mistassini, Québec, G8L3H6, Canada. Our company is duly registered in Quebec with QST number 1232908463 TQ0001 and GST number 747245363 RT0001.
By creating an account, installing our WordPress plugin or otherwise using our services accessible via tricotwp.com and tricotapp.com, you acknowledge that you have read, understand and accept these terms in their entirety without reservation. If you are acting on behalf of a company or organization, you represent and warrant that you have the authority to bind such entity to these terms. Your continued use of our service following any changes to these terms constitutes your acceptance of the new terms.
2. NATURE AND OPERATION OF THE SERVICE
Tricot revolutionizes the way WordPress site owners manage their translations by combining the power of a cutting-edge artificial intelligence engine with an intuitive interface. Our technical architecture is based on a distributed system where a lightweight plugin installed on your WordPress site communicates securely with our central application via a dedicated programming interface. This application processes your translation requests using artificial intelligence technologies recognized worldwide for their accuracy and reliability.
One of the fundamental features of our approach is that generated translations are stored directly in your local WordPress database. This architecture ensures that your translations always remain accessible and under your control, even in the event of a temporary interruption in our service. You benefit from the power of our translation infrastructure, while retaining complete autonomy over your multilingual content.
Our service offers a complete range of functions, including machine translation using artificial intelligence, multilingual content management, a validation table for reviewing and adjusting translations, automatic detection of content requiring translation, and advanced import and export tools. All of this is accessible via a centralized interface, enabling you to efficiently manage all aspects of your multilingual strategy.
3. REGISTRATION AND ACCOUNT MANAGEMENT
Creating an account is the first step in accessing all Tricot features. This registration process requires you to provide accurate and complete information, including a valid e-mail address, which will serve as the primary identifier for your account. Upon registration, our system automatically generates unique cryptographic credentials, including a license key and an API key, which will enable secure authentication between your WordPress installation and our infrastructure.
These identifiers are strictly personal and confidential. Their security is entirely your responsibility, and you undertake to take all necessary measures to prevent their disclosure or unauthorized use. Any activity carried out using your identifiers will be considered as having been carried out by you or under your authority. In the event of suspected compromise of your login details or unauthorized access to your account, you must notify us immediately so that we can take appropriate action, including regeneration of your security keys.
Your account is managed via our web interface, where you can view your consumption, modify your settings, manage your connected sites and access your translation history. You are responsible for keeping your account information up to date, and for ensuring that your e-mail address remains valid to receive important communications about the service.
4. PRICING STRUCTURE AND SUBSCRIPTION PLANS
Our commercial offering is structured around several subscription levels, each designed to meet different needs and volumes of use. The basic free plan allows users to discover our interface and perform manual translations without using our artificial intelligence engine. This option is an excellent starting point for sites with limited translation needs, or for those wishing to evaluate our platform before committing to a paid subscription.
Paid plans offer full access to our AI-based machine translation engine, with included translation volumes and advanced features that vary according to the level chosen. Each superior plan brings additional benefits in terms of included translation volume, support level, access to premium features and preferential rates on the purchase of additional resources. Specific details of each plan, including current prices and volumes included, are available on our website and may be modified periodically according to market conditions.
Prices displayed on our site are in Canadian dollars and exclude applicable taxes. Taxation varies according to your jurisdiction of residence: Canadian customers are subject to GST or HST according to their province, with the addition of QST for Quebec residents, while international customers must pay taxes in accordance with the regulations in force in their country. Our billing system, managed by our partner Stripe, automatically calculates the appropriate taxes during the payment process.
5. CREDIT SYSTEM AND CONSUMPTION
Our business model is based on a credit system in which each translation unit consumed is deducted from your balance. This transparent system enables you to precisely control your consumption and optimize the use of your translation resources. The credits included in your subscription are renewed at each billing period, usually annually, according to the terms of your plan.
Unused credits from one billing period are carried over to the next. This policy enables us to maintain a predictable cost structure while encouraging you to optimize your use of the service. For needs in excess of your periodical allocation, we offer the purchase of additional credits in different packages adapted to different usage volumes.
Credits remain available as long as your account is active, allowing you to build up a reserve for one-off translation projects or busy periods. The price of these extra credits varies according to your subscription level, with higher plans benefiting from more advantageous rates.
6. SUBSCRIPTION MODIFICATIONS AND CHANGING NEEDS
We understand that your site's translation needs may change over time, which is why we have established clear policies regarding subscription changes. Upgrading to a higher plan is generally possible at any time during your billing period. Upon such an upgrade, the system calculates a rate adjustment based on the remaining duration of your current subscription and the cost of the new plan. This upgrade takes effect immediately, starting a new billing cycle with all the benefits of the higher plan.
Downgrades to a lower plan are subject to stricter restrictions for operational and commercial reasons. After the initial cooling-off period following your first purchase, downgrades are generally not possible until the end of your current billing period. This policy ensures the stability of our business model while encouraging you to carefully evaluate your needs before choosing your plan. Plan changes take effect according to the specific terms and conditions detailed in your customer area.
Please note that the cooling-off period for flexible modifications applies only to your first subscription to our service. Automatic renewals and subsequent upgrades are considered firm commitments for the full billing period. This important distinction is designed to offer maximum flexibility to new users, while maintaining the predictability necessary for the quality of our service.
7. SATISFACTION AND REFUND POLICY
Our commitment to customer satisfaction is reflected in our clear and fair refund policy. New customers benefit from a trial period during which they can assess whether our service meets their expectations. If during this initial period you feel that our service does not meet your needs, you can request a refund in accordance with the established terms and conditions.
The refund calculation takes into account your actual use of the service during the relevant period. An amount proportional to your actual consumption will be deducted from the refund, reflecting the costs we have incurred in providing the translations. This fair approach ensures that you only pay for the services you actually use, while allowing us to cover the operational costs incurred.
It is crucial to understand that this refund policy applies exclusively to new subscriptions and not to renewals, upgrades or purchases of additional resources. Translation credits purchased separately from your subscription are not refundable under any circumstances, this condition being clearly indicated at the time of each transaction. To initiate a refund request, simply contact our support team, who will assess your eligibility and process your request as quickly as possible.
8. ACCEPTABLE AND ETHICAL USE
Use of our service must be in strict compliance with applicable laws and fundamental ethical principles. You agree to use Tricot exclusively to translate legitimate content for which you hold the necessary rights or have obtained the appropriate permissions. Our service is designed to handle the public content of your WordPress site, and we have implemented sophisticated filtering mechanisms that automatically detect and exclude sensitive data such as financial information or personal identifiers.
You are solely responsible for the content submitted for translation. You must ensure that texts do not infringe any intellectual property rights, do not contain any defamatory, hateful or illegal content, and comply with standards of decency and professionalism. Our system is not designed to translate content that is confidential or subject to special legal restrictions, and you agree not to use the service for such purposes.
It is strictly forbidden to use our service for malicious activities, including but not limited to attempting to overload our servers, mass data extraction, circumventing technical limitations, or creating competing services based on our infrastructure. Any attempt to reverse engineer, decompile or gain unauthorized access to our systems will result in immediate termination of your account and may result in legal action.
9. INTELLECTUAL PROPERTY AND LICENSING
All components of our service, including the WordPress plugin, web application, processing algorithms, user interfaces, graphics, technical documentation and trademarks, remain the exclusive and inalienable property of Tricot. These elements are protected by Canadian and international intellectual property laws, including copyright, patents and trademarks.
By subscribing to our service, we grant you a personal, limited, non-exclusive, non-transferable and revocable license to use our service in accordance with the terms of your subscription. This license allows you to install our plugin on the WordPress sites covered by your plan, and to access our web application to manage your translations. It does not confer any ownership rights to our technology, and does not authorize you to modify or create derivative works based on our service.
With regard to the content you submit and the translations generated, you retain full ownership of your original texts and of the translations produced by our service. Tricot does not claim any rights to these contents and undertakes not to use them for any purpose other than the provision of the translation service. We do not use your content to train artificial intelligence models or improve our algorithms without your explicit consent. This clear separation of property rights ensures that you retain full control over your intellectual property while benefiting from our translation technology.
10. CONFIDENTIALITY AND DATA PROTECTION
Protecting your personal and business data is a fundamental pillar of our commitment to our customers. Our approach to privacy is based on the principle of data minimization, which means that we only collect information that is strictly necessary for the optimal operation of our service. This is generally limited to basic identification data, content submitted for translation, and the technical metadata required to provide the service.
All communications between your WordPress site and our infrastructure are secured by high-level encryption protocols, ensuring that your data cannot be intercepted or compromised in transit. Our servers are hosted exclusively in data centers located in Canada, benefiting from a legal framework recognized for its robust privacy protection. This geographical location also ensures that your data is not subject to potentially less protective foreign jurisdictions. For an in-depth understanding of our data practices, we encourage you to consult our detailed Privacy Policy.
11. LIMITATIONS OF LIABILITY AND WARRANTIES
While we strive to provide the highest quality service possible, it is important to understand the inherent limitations of any technological solution. Our service is provided on an "as is" and "as available" basis, without any express or implied warranty as to its suitability for any particular purpose or the absolute accuracy of the translations generated. Artificial intelligence technologies, while extremely sophisticated, cannot guarantee perfect accuracy in all contexts, and human validation remains a crucial element of the professional translation process.
Our liability for any malfunction, error or interruption of service is strictly limited. In no event shall Tricot be liable for any indirect, consequential, special or punitive damages, including but not limited to lost profits, lost data, or business interruption. In the event that we are held liable, the maximum amount of compensation shall be limited to the amounts actually paid by you for the service during the twelve-month period preceding the incident.
This limitation of liability reflects the balanced allocation of risk between the parties and is an essential element of our ability to offer the service at competitive rates. We strongly encourage you to maintain regular backups of your content and implement your own translation verification and validation measures, especially for critical or legally sensitive content. Our unique architecture, which stores translations locally in your WordPress database, offers additional protection by ensuring that your translations remain accessible even if our cloud service is interrupted.
12. CUSTOMER SUPPORT AND ASSISTANCE
Our commitment to customer service excellence is demonstrated by the provision of multiple support channels tailored to different subscription levels. Support is mainly provided by e-mail, enabling detailed and documented follow-up of each request. Response times vary according to your subscription plan, with customers on higher plans receiving priority treatment of their requests.
In addition to reactive support, we provide comprehensive documentation, including the ongoing development of user guides, video tutorials, detailed FAQs and technical resources for developers. This knowledge base is regularly updated to reflect new features and answer questions frequently asked by our user community. We encourage our customers to consult these resources first, as they often contain immediate solutions to common problems.
Our support team is trained not only in the technical aspects of our platform, but also in best practices for translation and multilingual management of WordPress sites. This expertise enables us to offer you advice that goes beyond simple technical troubleshooting, helping you to optimize your translation strategy and get the most out of our service.
13. TERMINATION AND END OF SERVICE
The contractual relationship established by these conditions may be terminated in several ways. You retain the right to terminate your subscription at any time via your account management interface. This termination will take effect at the end of your current billing period, allowing you to continue using the service until that date. It is important to note that no pro rata refund will be given for unused time, except in cases specifically provided for in our refund policy.
For our part, we reserve the right to suspend or terminate your access to the service in the event of any breach of these terms, non-payment, fraudulent activity or misuse of the service. In such cases, termination may be immediate and without notice, particularly if the violation jeopardizes the security or integrity of our infrastructure or adversely affects other users of the service.
Upon termination, whatever the cause, the following effects apply: your access to the web application is deactivated, new automatic translations are no longer possible, but existing translations stored in your WordPress database remain accessible and usable. After a prolonged period of inactivity, usually twenty-four months, we reserve the right to permanently delete your account and associated data from our servers.
14. CHANGES TO CONDITIONS
The constantly changing technological and regulatory landscape may necessitate periodic adjustments to these terms and conditions of use. We reserve the right to modify these conditions at any time, with modifications taking effect according to the established notification procedures. For substantial changes affecting your rights or obligations, we undertake to notify you by e-mail at least thirty days before they come into force.
Notification of changes will be sent to the e-mail address associated with your account, so please keep this information up to date. Minor changes, such as clarifications or typographical corrections, may be made without prior notice. Your continued use of the service following the effective date of any changes constitutes your acceptance of the new terms.
If you do not accept the proposed changes, you have the right to terminate your subscription before they take effect. In this case, the previous conditions will continue to apply until the end of your current billing period. This balanced approach enables us to adapt our service to necessary changes while respecting your legitimate rights and expectations.
15. GENERAL PROVISIONS
These terms and conditions constitute the entire agreement between you and Tricot with respect to the use of our service, superseding any prior agreements, communications or proposals, whether oral or written. No modification of these terms shall be valid unless made in accordance with the procedures set forth in the preceding section or unless expressly accepted in writing by an authorized Tricot representative.
Should any provision of these terms and conditions be declared invalid or unenforceable by any competent authority, such invalidity shall not affect the remaining provisions, which shall remain in full force and effect. In such a case, the invalid provision will be replaced by a valid provision that comes as close as possible to the intent and economic effect of the original provision.
These terms are governed by the laws of the province of Quebec and the federal laws of Canada applicable therein, without regard to principles of conflict of laws. Any dispute arising out of these Terms or the use of our Service shall be subject to the exclusive jurisdiction of the courts of the judicial district of Dolbeau-Mistassini, Quebec, Canada. You irrevocably consent to the jurisdiction and venue of such courts.
